Terms of Service

Last updated: 1 June 2025. These terms govern all transport services provided by Wybicie Comfort Transport.

1. Definitions

"Wybicie" refers to Wybicie Comfort Transport, the operator of this website and provider of senior passenger transport services in Canada.

"Client" refers to the individual or family member who books or requests transport services on behalf of a passenger.

"Passenger" refers to the person being transported, who may or may not be the same person as the Client.

"Journey" refers to a single trip or series of connected trips arranged under one booking reference.

"Escort" refers to the trained Wybicie staff member assigned to accompany the Passenger.

2. Scope of services

Wybicie provides passenger transport services designed for seniors and elderly individuals, including airport transfers, intercity routes, medical appointment transport, and cross-border journeys. All services are provided within the limitations set out in the confirmed booking agreement.

Wybicie is a transport service, not a medical care provider. Escorts are trained in first aid and mobility assistance but are not licensed healthcare professionals and may not administer medication or perform medical procedures.

3. Booking and confirmation

A booking is considered confirmed only after Wybicie has issued a written booking confirmation by email, specifying the route, date, vehicle, and agreed price. Verbal confirmations or acknowledgements of a trip request do not constitute a binding booking.

The Client is responsible for providing accurate information regarding the Passenger's mobility requirements, medical equipment, and any other special needs at the time of booking. Failure to disclose relevant information may affect our ability to provide appropriate care during the journey.

Wybicie reserves the right to decline bookings that exceed our operational capacity or fall outside our service area.

4. Pricing and payment

Prices are provided on a per-journey basis following receipt of a complete trip brief. The price stated in the booking confirmation is the total price payable. No additional charges will be applied for fuel, tolls, or waiting time unless these arise from changes requested by the Client after confirmation.

Payment terms are specified in the booking confirmation. Wybicie accepts payment by bank transfer and credit card through arrangements communicated directly to the Client.

5. Cancellation policy

  • More than 72 hours before departure: full refund issued within 5 business days.
  • 48–72 hours before departure: 50% refund of the total booking value.
  • Less than 48 hours before departure: no refund. The full booking amount is due.
  • Cancellations due to documented medical emergency: handled individually; contact us promptly.

Wybicie will not charge cancellation fees if we are unable to fulfil a confirmed booking due to vehicle failure or staff unavailability, and will provide a full refund in such cases.

6. Punctuality and delays

Wybicie escorts arrive at least 15 minutes before the scheduled departure time. In the event of traffic delays or circumstances beyond our control, we will notify the Client and Passenger as promptly as possible and make every effort to minimise the impact on the journey.

For airport transfers, Wybicie recommends allowing adequate time buffers and accepts no liability for missed flights resulting from circumstances outside our operational control (traffic, road closures, weather events).

7. Passenger responsibilities

The Client or Passenger is responsible for:

  • Being ready at the agreed pick-up time and location.
  • Providing valid travel documents (passports, visas) for international journeys.
  • Ensuring that any medical equipment brought on the journey (oxygen concentrators, CPAP machines, etc.) is in working order and appropriately prepared for transport.
  • Informing Wybicie of any changes to the Passenger's condition that may affect travel safety.

8. Luggage

Wybicie vehicles accommodate standard personal luggage appropriate to the journey type. Excessive luggage that prevents safe vehicle loading or affects passenger comfort may be refused. Contact us in advance if you anticipate unusual luggage requirements.

9. Limitation of liability

Wybicie carries appropriate commercial vehicle insurance covering passengers during transport. Our liability is limited to direct damages arising from proven negligence by Wybicie staff during the provision of the confirmed service.

Wybicie does not accept liability for: loss or damage to personal belongings unless caused by proven Wybicie negligence; delays caused by third parties, road conditions, or weather; changes to journey requirements after confirmation; or any consequential, indirect, or incidental losses.

10. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes arising from these Terms or from Wybicie's services will be subject to the exclusive jurisdiction of the courts of Ontario.

11. Amendments

Wybicie may update these Terms from time to time. The current version is always available at this URL. Continued use of our services after an update constitutes acceptance of the revised Terms.
